As a service provider, under general law § 7 Abs.1 According to the TMG, we are responsible for our own content on these pages. Terminology used

“Personal data” means any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier (e.g. cookie) or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

“Processing” means any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means. The term goes very far and includes almost all data processing.

‘pseudonymization’ means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and subject to technical and organizational measures to ensure that the personal data is not attributed to an identified or identifiable natural person.

“Profiling” means any form of automated processing of personal data consisting in the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects relating to that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location or movements.

“Controller” means a natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of processing personal data.

“Processor” means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

Relevant legal bases

In accordance with Article 13 GDPR, we inform you about the legal basis for our data processing. For users within the scope of the General Data Protection Regulation (GDPR), i.e. EU and EEC, the following applies, unless the legal basis is specified in the data protection declaration:

The legal basis for obtaining consent is Art. 6 para. 1 lit. a and Art. 7 GDPR;

The legal basis for processing for the performance of our services and the implementation of contractual measures and for answering questions is Art. 6 para. 1 lit. b GDPR;

The legal basis for processing to fulfill our legal obligations is Art. 6 para. 1 lit. c GDPR;

If the vital interests of the data subject or another natural person require the processing of personal data, Art. 6 para. 1 lit. d GDPR serves as the legal basis.

The legal basis for processing necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller is Art. 6 para. 1 lit. e GDPR.

The legal basis for processing to protect our legitimate interests is Art. 6 para. 1 lit. f GDPR.

Processing of data for purposes other than those for which they were created is subject to the requirements of Article 6(4) GDPR

The processing of special categories of data (pursuant to Article 9(1) GDPR) is subject to the provisions of Article 9(2) GDPR.

Security measures

In accordance with legal requirements, we take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, taking into account the state of the art, the costs of implementation and the nature, scope, conditions and purposes of processing, as well as the likelihood and seriousness of the risk to the rights and freedoms of natural persons.

Measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to data, as well as access, entry, disclosure, availability and segregation. We have also established procedures to ensure the exercise of data subject rights, erasure of data and reaction to data compromises. We also take into account the protection of personal data involved in the development or selection of hardware, software and procedures in accordance with the data protection principle through technology design and data protection-friendly default settings.

Collaboration with processors, co-controllers and third parties

In the context of our processing, if we disclose data to other persons and companies (processors, joint controllers or third parties), transfer it to them or otherwise allow them access to the data, this will only be done on the basis of a legal authorization (e.g. if the data needs to be transmitted to third parties such as payment service providers for contract fulfillment), if users are under a legal obligation to do so, or based on our legitimate interests (e.g. when using agents, web hosts, etc.).

If we disclose, transmit or otherwise grant access to data to other companies in our group of companies, this is done in particular for administrative purposes as a legitimate interest and, beyond that, in accordance with legal requirements.

Transfers to third countries

If we process data in a third country (i.e. outside the European Union (EU), the European Economic Area (EEA) or the Swiss Confederation) or if this is done in the context of the use or disclosure of third-party services or the transmission of data to other persons or companies, this will only be done on the basis of your consent, where this is necessary to fulfill our (preliminary) contractual obligations, is based on a legal obligation or our legitimate interests. Subject to legal or contractual authorizations, we only process or release data in a third country if legal requirements are met. This means that the processing takes place on the basis of specific guarantees, such as, for example, the officially recognized level of data protection corresponding to the EU (e.g. for the USA “through the Privacy Shield”) or compliance with specific officially recognized contractual obligations.

Rights of data subjects

You have the right to request confirmation as to whether the data concerned is being processed and to obtain information about this data, as well as further information and a copy of the data in accordance with legal requirements.

Accordingly, there are legal requirements, the right to demand the completion of data concerning you or the rectification of incorrect data concerning you.

In accordance with legal requirements, you have the right to demand the immediate deletion of the data concerned or, alternatively, to request the restriction of the processing of the data in accordance with legal requirements.

You have the right to request that the data about you that you provide to us be collected and transmitted to other controllers in accordance with legal requirements.

You also have the right to lodge a complaint with the competent supervisory authority in accordance with legal requirements.

Withdrawal

You have the right to revoke your consent with effect for the future.

Right of appeal

You can object at any time to future processing of your data in accordance with legal requirements. The objection can be made in particular against processing for direct marketing purposes.

Right to object to cookies and direct marketing

“Cookies” are small files stored on users’ computers. Different information can be stored in cookies. A cookie is primarily used to store information about a user (or the .dem device on which the cookie is stored) during or after a visit to an online offer. Temporary cookies or “session cookies” or “transient cookies” are cookies that are deleted after a user leaves an online offer and closes their browser. In such a cookie, for example, the contents of a shopping cart in an online shop or the login status can be stored. “Persistent” or “permanent” cookies are cookies that are stored even after closing the browser. For example, the login status can be saved if users visit after a few days. Deletion of data

The data processed by us will be deleted or restricted in its processing in accordance with legal requirements. Unless expressly stated in this data protection declaration, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and the deletion does not conflict with any legal storage obligations.

If the data are not deleted because they are necessary for other and legally permitted purposes, their processing will be restricted. This means that the data will be blocked and will not be processed for other purposes. This applies, for example, to data that must be stored for commercial or tax reasons.

Changes and updates to the Privacy Policy

We ask you to inform yourself regularly about the content of our privacy policy. We will adapt the privacy policy as soon as changes in the data processing we carry out make this necessary. We will inform you if the changes require an act of cooperation on your part (e.g. consent) or other individual notification.

Hosting and email sending

The hosting services used by us serve to provide the following services: infrastructure and platform services, computing capacity, storage and database services, email delivery, security services and technical maintenance services that we use to operate this online offering.

In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, metadata and contact data of interested parties and visitors of this online offer on the basis of our legitimate interests in the effective and secure provision of this online offer in accordance with Art. 6 para. 1 lit. f f GDPR in conjunction with Art. 28 GDPR (conclusion of the order processing contract).

Collection of access data and log files

We or our hosting provider collect data about each access to the server on which this service is located (so-called server log files) on the basis of our legitimate interests within the meaning of Art. 6 para. 1 lit. f. GDPR. The access data includes the name of the retrieved website, the file, the date and time of retrieval, the amount of data transferred, the successful retrieval notification, the browser type and version, the user’s operating system, the referrer URL (previously visited page), the IP address and the requesting provider.

Log file information is kept for security reasons (e.g. to investigate abuse or fraud) for a maximum of 7 days and then deleted. Data that needs to be kept longer for evidentiary purposes is exempt from deletion until the relevant incident is finally clarified.

Integration of third-party services and content

Based on our legitimate interests (i.e. our interest in the analysis, optimization and economic functioning of our online offer within the meaning of Art. 6 para. 1 lit. f. GDPR), we use content or service offers of third-party providers in our online offer to integrate their content and services, such as videos or fonts (hereinafter also referred to as “content”).

This always requires third-party providers of this content to detect the IP address of users, as they cannot send the content to their browsers without the IP address. The IP address is therefore required for the display of this content. We try to use only content that uses only the IP address to deliver the content to the respective providers. Third parties may use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. “Pixel tags” may be used to evaluate information such as visitor traffic on the pages of this website.
